Summerfield Properties LLC Lawsuit

The Town of Summerfield and Summerfield Properties LLC, developers of the Armfield residential development, have reached a settlement in the case 08 CVS 6002.  The case was brought by Summerfield Properties LLC against the Town of Summerfield when the Town denied the approval of a revised rezoning request to allow for additional residential development within the Armfield neighborhood.

The Town Council took the unusual step of requesting a meeting between staff, developer, and residents of the neighborhood to attempt to negotiate a settlement of the case.  This meeting provided the opportunity for residents to have their concerns addressed on issues both related to the rezoning and other general neighborhood issues.   The final point of contention, the provision of a “look-back” period to allow for more than 75 lots to be platted in a year, was dropped by the developer during the negotiations.  This cleared the way for representatives of the neighborhood to support to settlement agreement.  Based on this approval the Town Council accepted the proposed settlement at their August 12, 2008 Town Council meeting.  The vote was unanimous with the noted absence of Mayor Brown and Councilperson Strickland.

The settlement will allow the developer to plat an additional 24 single family residential lots to the existing 290 currently allowed.  The developer will only be allowed to plat 75 lots per year and provide environmental protection to existing wetlands and pond on the property, among other zoning conditions previously agreed.

This settlement will bring this matter to a close.
